These Terms govern your use of the 2 Be Happy platform, community sessions, Happiness Hubs, and all related services. By joining us, you enter a relationship built on mutual respect, trust, and shared purpose.

Our Agreement With You

A Community Built on Shared Values

Welcome to 2 Be Happy — a wellness and community initiative operated by Mr & Mrs Happiness Initiatives. These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("Member" or "Visitor") and Mr & Mrs Happiness Initiatives ("we", "us", "our") governing your access to and use of the website www.2behappy.org, our Happiness Hubs, Mood Booster sessions, community forums, and all related services.

By accessing our website, submitting your details, attending any session, or participating in any community activity, you confirm that you have read, understood, and unconditionally agreed to these Terms. If you do not agree, please do not use our platform or services.

These Terms should be read alongside our Privacy Policy and Disclaimer, which form part of this agreement.

About Us & Our Platform

2 Be Happy is a sub-brand (unit) of Mr & Mrs Happiness Initiatives, a social wellness enterprise founded by Mrs. Santana Jha Kolay (Founder & Owner), headquartered in Chandannagore, Hooghly District, West Bengal, and operational from Ranchi, Jharkhand, India.

Our platform is a virtual wellness community comprising ten specialised Happiness Hubs, one-to-one Mood Booster mentorship sessions, group discussion forums, and wellness blog content ("The Reflection"). All services are delivered digitally via our website, WhatsApp, and virtual meeting platforms.

Our Purpose: We are a passion-driven, socially motivated initiative. Our primary goal is the genuine wellbeing of our members. Income generation is secondary. All activities are designed to promote happiness, mental wellness, and purposeful living — and shall remain 100% ethical and legal at all times.

We are in the process of formal registration as a business entity under the MSME (Micro, Small and Medium Enterprises) scheme, Government of India. All payments, legal documents, and financial records are maintained under Mr & Mrs Happiness Initiatives.

Acceptance of Terms

Your acceptance of these Terms is expressed through any of the following actions:

Visiting or browsing the website www.2behappy.org
Submitting your details through our "Connect 2 Happiness" registration form
Attending any free or paid session, workshop, or community activity
Joining any Happiness Hub as a participant
Communicating with us via WhatsApp, email, or any other channel for the purpose of our services

Important Note on Age: By accepting these Terms, you confirm that you are at least 18 years of age, or that you are a minor accessing the platform with the explicit knowledge and consent of your parent or legal guardian. Persons under 18 may only participate in the Junior Sparklers Hub with verified parental consent.

Membership & Eligibility

Membership in 2 Be Happy's community is open to any individual who shares our commitment to personal growth, wellness, and authentic human connection. There are two levels of participation:

🌿 Level 1 — Visitor / Enquirer:

Any person who visits our website or submits an enquiry
Eligible for one free Discovery Session to explore our community
No obligation to continue after the Discovery Session

🌿 Level 2 — Active Community Member:

A person who has attended at least two sessions and expressed intent to continue
Subject to a personal membership agreement to be signed separately
Entitled to full access to their chosen Happiness Hub and associated community benefits
Agrees to all community conduct obligations as set out in these Terms

We reserve the right to decline membership to any individual at our sole discretion, without being required to provide a reason, particularly where we believe the individual's participation may not align with our community's values or the wellbeing of other members.

Community Code of Conduct

2 Be Happy is a safe, respectful, and empathetic space. Every member carries a shared responsibility for maintaining the sanctity and positive energy of our community. By participating, you agree to the following Code of Conduct:

You WILL:

Treat all fellow members, facilitators, and guests with dignity, respect, and kindness
Engage honestly and authentically, contributing positively to group discussions
Maintain strict confidentiality — what is shared in sessions stays within the session
Honour the scheduled session times and notify us in advance if unable to attend
Support the emotional wellbeing of fellow members without judgement

You will NOT:

Use the platform for commercial solicitation, promotion, or advertising of any personal business or service
Record, photograph, or screenshot any session or member without explicit written consent of all participants
Share, post, or publish personal disclosures of other members on any social media, messaging platform, or public forum
Engage in bullying, harassment, body shaming, discrimination based on gender, religion, caste, age, or any other characteristic
Use offensive, abusive, or inappropriate language in any session or communication
Attempt to access any session or Hub to which you are not registered
Impersonate any person, facilitator, or team member of 2 Be Happy
Share or distribute any content from our sessions without prior written permission from Mr & Mrs Happiness Initiatives

Violation of this Code of Conduct may result in immediate suspension or permanent removal from the community without refund, and may attract legal action where applicable.

Sessions, Hubs & Services

2 Be Happy offers the following services, subject to availability and at our discretion:

Happiness Hubs (10 Specialised Groups): Structured virtual group sessions designed for specific life stages and interests — from Junior Sparklers to Golden Chapters
Mood Booster: Private one-to-one mentorship and motivation sessions with a trained facilitator
Discovery Session: One free introductory session offered to all new enquirers
The Reflection (Blog): Written wellness content published on our website for general access
Community Events: Periodic workshops, themed discussions, and awareness sessions

Important Service Limitations:

All sessions are conducted virtually via agreed platforms (e.g., Google Meet, Zoom, WhatsApp). Physical meetups, if ever organised, will be separately communicated and agreed upon
Session schedules are set by us and may be changed, postponed, or cancelled with reasonable prior notice
We do not guarantee specific outcomes from participation. Results depend on individual engagement, consistency, and personal effort
Our services are not a substitute for professional medical, psychiatric, or therapeutic treatment. Members requiring clinical support are encouraged to seek qualified professional help

Fees, Payments & Refunds

Our fee structure is designed to be fair, transparent, and accessible. The following terms govern all financial transactions with Mr & Mrs Happiness Initiatives:

a) Discovery Session:

The first Discovery Session is offered completely free of charge to all new enquirers with no obligation to continue.

b) Paid Sessions & Membership:

Fees for ongoing participation in Happiness Hubs and Mood Booster sessions will be communicated clearly and individually before commitment is required
All payments are to be made to Mr & Mrs Happiness Initiatives via agreed payment methods (bank transfer, UPI, or other approved digital channels)
A formal receipt or acknowledgement will be issued for all payments received
Fees may be revised periodically. Any revision will be communicated at least 30 days in advance to active members

c) Refund Policy:

Fees paid for sessions already attended are non-refundable
If a session is cancelled by us without adequate rescheduling, a full refund or credit for the cancelled session will be offered
If a member voluntarily discontinues participation mid-cycle, fees for unused sessions may be refunded at our discretion on a case-by-case basis, subject to reasonable notice
Refund requests must be raised within 7 days of the triggering event by contacting us directly via WhatsApp or phone

Intellectual Property

All content created by and associated with 2 Be Happy and Mr & Mrs Happiness Initiatives is our exclusive intellectual property. This includes:

The 2 Be Happy brand name, logo, taglines, and visual identity
All website content — text, graphics, layout, structure, and design
Session frameworks, programme structures, and facilitation methodologies
Blog articles, written content ("The Reflection"), and educational materials
The names and concepts of all ten Happiness Hubs
The concept and framework of the Mood Booster programme

What you may NOT do:

Copy, reproduce, publish, or distribute any content from our platform without prior written permission from Mr & Mrs Happiness Initiatives
Use our brand name, logo, or any associated marks for any purpose — commercial or personal — without authorisation
Record sessions and use the content for any purpose — personal or commercial — without written consent
Create derivative works based on our frameworks or session content without explicit agreement

Violation of our intellectual property rights may result in legal action under applicable Indian law, including the Copyright Act, 1957 and the Trade Marks Act, 1999.

Members retain ownership of their own personal stories and disclosures shared during sessions. However, by participating, you grant us the right to use anonymised, non-identifiable insights from community discussions to improve our programmes.

Confidentiality Obligations

The trust and safety of every member is sacred to us. Our sessions involve personal, sometimes deeply private, sharing. The following confidentiality obligations are binding on every participant — including facilitators, co-facilitators, members, and guests.

Every participant agrees that:

Personal stories, struggles, disclosures, and opinions shared by any member during any session are strictly confidential
No personal information shared by another member may be discussed, shared, or disclosed outside the session — not even with close friends or family
No session may be recorded in any form (audio, video, screenshot) without the explicit written consent of all participants and the facilitator
Breach of this confidentiality obligation is a serious violation of these Terms and of the trust of your fellow members

Consequences of Breach: Any member found to have violated these confidentiality obligations will be immediately and permanently removed from the community. We reserve the right to pursue legal remedies under applicable Indian law for serious breaches.

We — as facilitators and administrators — are equally bound by this confidentiality commitment. Your disclosures will never be shared beyond the facilitation team without your explicit consent.

Termination & Removal

Either party — you or us — may end the membership relationship. The following terms apply:

a) Voluntary Exit by Member:

You may discontinue your participation at any time by notifying us via WhatsApp or phone
Please provide at least 7 days' notice out of respect for the facilitator and co-members who plan sessions around attendance
Your personal data will be handled as described in our Privacy Policy upon exit

b) Removal by Us:

We reserve the right to suspend or permanently remove any member, with immediate effect and without prior notice, in the following circumstances:

Violation of the Community Code of Conduct (Section 4)
Breach of the confidentiality obligations (Section 8)
Any behaviour that disrupts, harms, or threatens the wellbeing of other members or facilitators
Misrepresentation of identity, age, or intent during registration
Non-payment of agreed fees without reasonable cause or communication
Any conduct that brings disrepute to the 2 Be Happy community or Mr & Mrs Happiness Initiatives

Removal decisions by us are final. Fees paid for sessions already attended are non-refundable in cases of removal for conduct violations.

Limitation of Liability

While we are deeply committed to the wellbeing of every member and deliver our services with utmost care and sincerity, we operate as a social wellness community — not a clinical or medical service. The following limitations apply:

Mr & Mrs Happiness Initiatives shall not be liable for any physical, psychological, emotional, financial, or other consequences arising from your participation in our sessions or your interpretation of content shared during sessions
We do not guarantee specific outcomes — such as reduction of stress, resolution of personal problems, or improvement in professional performance — as results depend entirely on individual effort and circumstances
We are not responsible for the accuracy of personal advice shared by other community members during group discussions
We are not liable for any technical failures — including connectivity issues, platform outages, or audio/video problems — during virtual sessions
Our total liability to any member, in any circumstance, shall not exceed the total fees paid by that member for the service in question

If you are experiencing a mental health emergency or crisis, please immediately contact a qualified mental health professional, your nearest hospital, or a crisis helpline. Our sessions are supportive community spaces — not emergency services.

Changes to These Terms

We may update or revise these Terms & Conditions from time to time as our community grows, our services evolve, or as required by changes in applicable Indian law. When material changes are made:

Active members will be notified via WhatsApp or email at least 15 days before changes take effect
The "Effective Date" at the top of this page will be updated to reflect the most recent revision
The updated Terms will be published on our website at www.2behappy.org/terms-and-conditions.html

Your continued participation in any session or community activity after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree with any revision, you may exit the community as described in Section 9.

Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of the Republic of India. The following statutes are specifically applicable:

The Information Technology Act, 2000 — governing digital services and electronic contracts
The Indian Contract Act, 1872 — governing the binding nature of this agreement
The Consumer Protection Act, 2019 — governing consumer rights and dispute resolution
The Copyright Act, 1957 — governing our intellectual property rights

Dispute Resolution: In the event of any dispute, claim, or disagreement arising from these Terms or your participation in our community, both parties agree to first attempt resolution through direct, good-faith communication. We are a people-first organisation and believe most concerns can be resolved through honest conversation.

If direct resolution is not possible, the matter shall be subject to the exclusive jurisdiction of courts located in Jharkhand, India. Both parties waive any objection to the venue or jurisdiction of such courts.
